A bank in West Valley City, UT, was built in a developing area near a two-acre field. This field was a gopher nursery and during nesting season the population would spill over or spread onto the bank property, destroying the landscaping. The animals feasted on the flowers and shrubs and left mounds and trails all over the lush yard. Numerous efforts, including application of some popular home-remedy repellents, failed to make a dent in the problem. It was time to get rid of gophers.

The bank became very annoyed at the mess and damage that they could do so very little about. The source of the problem wasn\'t even their own property, so how would they be able to solve it? The bank was happy to have the animals gone. The owner of the field was glad to have a happy neighbor instead of a lawsuit. I was happy the situation was resolved.

The moral of the story is: consider the source! When you have a nuisance animal problem, you have to look at the entire problem. No Bird Nest Removal in West Valley City, Utah Hard to \"Swallow\"

I am a local attorney and recently advised my client in her efforts to get rid of mud swallows nesting on the entrance archway of her home. The swallows made a mud nest and then hatched four babies.

She said the swallows are becoming a huge nuisance. Her window below the archway and front steps are covered in swallow excrement. The babies are now old enough to fly on their own, but they are not leaving. She wanted to know what she could legally do to remove the swallows as she heard they were federally protected.

She was right. Swallows, as well as many other birds, are protected under the Migratory Bird Treaty Act of 1918. This act makes it illegal to \"pursue, hunt, take, capture, kill, attempt to take, capture or kill, possess, etc. . . any migratory bird . . . for the protection of migratory birds . . . or any part, nest, or egg of any such bird (16 United States Code 703).

If a person violates the act they could face fines up to $15,000 and possible prison sentences for every swallow, egg or nest that is destroyed. When the birds are able to fly, the nest can be removed.

I advised her that she could get rid of the swallows\' nest, but that she and her husband would have to wait until the swallows decide to leave the nest on their own.
